1.    Interpretation

The following definitions and rules of interpretation apply in the terms.

Delivery: The transfer of physical possession of the Equipment to the Customer at the Site.

Commencement Date: the date that the Customer takes Delivery of the Equipment.

Customer: The person or corporate entity who is taking physical possession the Equipment from the Supplier in accordance with the terms of this agreement.

Data Protection Legislation: (i) Unless and until the GDPR is no longer directly applicable in the UK, the General Data Protection Regulation ((EU) 2016/679) and any national implementing laws, regulations and secondary legislation, as amended or updated from time to time, in the UK and then (ii) any successor legislation to the GDPR or the Data Protection Act 1998.

Site: The Customer’s premises details of which are to be provided at the time of the Order.

Supplier: Nomad Equipment trading under Momentum Hire Limited whose registered address is 34 Harebell Close Walnut Tree, Milton Keynes, Bucks, United Kingdom, MK7 7BA (Company Number: 10590400)

Total Loss: The Equipment is, in the Supplier’s reasonable opinion or the opinion of its insurer(s), damaged beyond repair, lost, stolen, seized or confiscated.

VAT: Value added tax or any equivalent tax chargeable in the UK.

Clause, Schedule and paragraph headings shall not affect the interpretation of this agreement.

A person includes a natural person, corporate or unincorporated body (whether or not having separate legal personality) and that person’s legal and personal representatives, successors and permitted assigns.

The Schedules form part of this agreement and shall have effect as if set out in full in the body of this agreement and any reference to this agreement includes the schedules.

A reference to a company shall include any company, corporation or other body corporate, wherever and however incorporated or established.

Unless the context otherwise requires, words in the singular shall include the plural and in the plural shall include the singular.

Unless the context otherwise requires, a reference to one gender shall include a reference to the other genders.

A reference to a statute or statutory provision is a reference to it as amended, extended or re-enacted from time to time.

A reference to a statute or statutory provision shall include all subordinate legislation made from time to time under that statute or statutory provision.

A reference to writing or written includes fax and e-mail.

Any obligation on a party not to do something includes an obligation not to allow that thing to be done.

A reference to this agreement or to any other agreement or document referred to in this agreement is a reference to this agreement or such other agreement or document as varied or novated (in each case, other than in breach of the provisions of this agreement) from time to time.

References to clauses and Schedules are to the clauses and Schedules of this agreement and references to paragraphs are to paragraphs of the relevant Schedule.

Any words following the terms including, include, in particular, for example or any similar expression shall be construed as illustrative and shall not limit the sense of the words, description, definition, phrase or term preceding those terms.

2.    Background

Nomad Equipment is a specialized supplier of fitness equipment in the United Kingdom. Before considering a product ensure you understand the need for such and it is recommended that you consult your doctor before ordering.

The information on the website is updated on a regular basis, however, Nomad Equipment cannot be liable for any omissions or errors and the product ordered may differ from the photo due to upgraded or presence.

3.    Products and ordering a product

The website indicates the product, product description and specifications. It also indicates the selling price at that point in time which may change from time to time. The product may not be in stock when visiting the website but should you be interested in such a product, Contact Us.

Before selecting a product ensure that this will satisfy your need. Evaluate the product specifications and ensure that the product will fit into the area you have in mind for the product. Once you have identified your preferred product, select it and continue to checkout. Before paying for the product, please read and understand the terms and conditions of the sale covered herein.

Payment is made when the order is placed. Payment can be done using secure payment gateways as detailed on the secure payment page.

4.    Delivery and delivery fees.

We have good news. We offer free deliver to most areas in the UK with a few exceptions which require surcharges.

Free Installation, Demo and Delivery [Standard]

We offer a free assembly, installation and a demo service for all products for delivery to specified postcodes. Delivery will be arranged within 2 days of the order being placed. The equipment ordered will usually be delivered within 5-7 working days if the item ordered is in stock. Installation is restricted to the ground floor with no restrictions and is subject to an upstairs downstairs delivery fee if not on the first floor.

Free Deliveries [Standard]

We delivery for free to all products for delivery to mainland UK addresses. Delivery will be arranged within 2 days of the order being placed. The equipment ordered will usually be delivered within 5-7 working days if the item ordered is in stock. Delivery is to the sidewalk of place of delivery or front door with no restrictions. This service does not cover offshore locations.

Offshore Deliveries [Standard]

A standard off-shore delivery services is available to addresses in Northern Ireland, Republic of Ireland and Isle of Man. To ensure the delivery agent surcharges are not applicable please contact us for a quote.


This refers to access to the property and includes road restrictions, stairs, obstructions, hedges, road and construction works, narrow access to the property and tight corners.

Optional Delivery Extras

Upstairs / Downstairs Deliveries

We offer delivery to the first floor or one floor underground using a two-man delivery team at a cost of £40.The product will be delivered to a cleared room of your choice with no restrictions.

This service is restricted depending on location and details will be provided on checkout.


If ordered outside of the free installation area the product can be assembled for you either on site at a fee of £60 or pre-assembled in the warehouse before delivery for £50. (It may, due to the size and access to the preferred delivery area, be partly assembled at the warehouse and then finally assembled on site.)

Product packaging

All unassembled products come in flat packed boxes. Two people are required to handle and assemble the equipment. To see the dimensions and weight of the boxes please refer to the product page. Use the guide supplied to assemble the items and please contact Nomad Fitness Ltd if you have any questions regarding assembly of your goods.

Delivery Process

Delivery Tracking: Delivery will be arranged within 2 days of the order being placed. A text message will be sent to confirm delivery information the day before.

Failed Delivery: You need to ensure they are available in the timeslot arranged. If not available within that timeslot a failed delivery charge of £30 will be processed and redelivery will be arranged.

Reschedule Delivery: If you need to reschedule delivery please ensure you contact us within 24hrs of the delivery confirmation to reschedule to ensure no charges will be acquired.

Damaged goods or boxes: When the delivery arrives please check the boxes and if they or the goods are clearly damaged you are able to refuse the delivery. Contact Us to arrange for the replacement of the goods.

Check breakage/faulty goods: Ensure you have checked all the packaged items and if any are damaged or broken you need to contact us within 48hrs to return or replace the damaged goods.

5.    The right to cancel and refunds

You have full to cancel an order for goods and starts the moment you place your order and ends 14 days from the day you receive your goods.

Exclusions to this include:

  • This does not apply to products made specifically to your specifications.
  • Should the product be assembled or disassembled why whom whatsoever including Nomad Equipment, the regulations will not apply.

The goods need to be in the same state as when it was delivered, unused and in the original packing. If the product has been used or you do not have the packaging, there will be a deduction from your refund to reflect the diminished value of the goods. The cost to return the goods will be for the account of the customer.

Should the product be returned, Nomad Equipment has the right to deduct from the refund, a value that the product is worth less due to the condition it was returned in which include use, packaging or damages.

Nomad Equipment must be informed of the decision to return the product in writing to the registered address, 34 Harebell Close, Milton Keynes or via e-mail at customerservice@nomadequipment.com.

7.    Limited Warranty

All products supplied were carefully selected is covered by a limited warranty. For a period of 12 months after delivery of the product, Nomad Equipment warrants the product from defect of material and workmanship should the product be used as intended and serviced in accordance with the instruction manual supplied.

Although durable and reliable products are offered, the warranty covers only domestic use of such and exclude normal wear and tear. The warranty specifically excludes cases where the product was altered, modified, damaged, altered or repaired by any party excluding an authorized repair by Nomad Equipment or his agent or where the product was exposed to abuse or incorrect use and not properly maintained (as indicated in the instruction manual). The warranty applies to the customer only and is not transferrable. It also excludes unforeseen circumstances which include earth quakes, fire, lighting, accidents and flooding. And when the serial number is unreadable or changed/altered.

Your product warranty needs to be validated by registering the product here. Should you encounter a problem, we strongly advise to refer to your instruction manual for assistance. Do not repair the product yourself or by others as this will invalid the warranty. If the problem persists, call us for assistance.

8.    Force majeure

Neither party shall be in breach of this agreement nor liable for delay in performing, or failure to perform, any of its obligations under this agreement if such delay or failure result from events, circumstances or causes beyond its reasonable control. In such circumstances the time for performance shall be extended by a period equivalent to the period during which performance of the obligation has been delayed or failed to be performed. If the period of delay or non-performance continues for 3 weeks, the party not affected may terminate this agreement by giving 2 days’ written notice to the affected party.

9.    Data Protection and Data Processing

Both parties will comply with all applicable requirements of the Data Protection Legislation for further information in relation to the Supplier’s Data Protection Policy and Privacy Policy can be found on the following webpage: https://nomadequipment.com/privacy-cookie-policy/.

10. Waiver

No failure or delay by a party to exercise any right or remedy provided under this agreement or by law shall constitute a waiver of that or any other right or remedy, nor shall it prevent or restrict the further exercise of that or any other right or remedy. No single or partial exercise of such right or remedy shall prevent or restrict the further exercise of that or any other right or remedy.

11.  Rights and remedies

Except as expressly provided in this agreement, the rights and remedies provided under this agreement are in addition to, and not exclusive of, any rights or remedies provided by law.

12. Severance

If any provision or part-provision of this agreement is or becomes invalid, illegal or unenforceable, it shall be deemed deleted, but that shall not affect the validity and enforceability of the rest of this agreement.

If any provision or part-provision of this agreement is deemed deleted under clause above the parties shall negotiate in good faith to agree a replacement provision that, to the greatest extent possible, achieves the intended commercial result of the original provision.

13. Governing law

This agreement and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with it or its subject matter or formation shall be governed by and construed in accordance with the law of England.

14. Jurisdiction

Each party irrevocably agrees that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with this agreement or its subject matter or formation.

16. WEEE Compliance

Each EU Member State now has a legal obligation to minimise the disposal of Waste Electrical and Electronic Equipment (WEEE) in landfill sites.

The broad aim of the WEEE regulations is to address the environmental impacts of electrical and electronic equipment when it reaches the end of its life.

We all have a responsibility to contributing to the reuse, recycling and other forms of recovery of WEEE under these Regulations.

Over 75% of waste electrical goods end up in landfill, where lead and other toxins contained in the electrical goods can cause soil and water contamination which can lead to negative effects on human health and the environment.

Electrical and Electronic Equipment that was made after 13th August 2005 should display the crossed-out wheelie bin symbol on the packaging or product. The purpose of the symbol is to encourage householders to dispose of their WEEE separately from household waste.
